The Kinder Eggs were invented by Michele Ferrero and they are manufactured by the Ferrero company. Each year the Ferrero company used to sell 1.5 billion eggs. What Makes Kinder Egg Illegal in the USA?

Kinder Eggs are illegal in the United States because chocolate with a surprise toy inside is not allowed in the United States. In 1938, according to the Food, Drug, and Cosmetic Act, Kinder Eggs were considered to be illegal as they violate the rule “Watershed in the US food policy.” This act was drafted to protect the public from non-nutritive objects and unscrupulous manufacturers.

And notably, around 107 people (most of them were children) died because of Kinder Eggs as the toy choked many kids and there were several warnings due to its foil packaging. And the news has been widely spread and popularly known as the “1937 Elixir Sulfanilamide Incident.” Sulfanilamide is not as it sounds like a terrifying chemical. It is a safe antibiotic when it is administered properly and it is also used to treat streptococcal infections by combining with other things. 

To avoid Elixir Sulfanilamide’s tragedy, the United States banned the Kinder Eggs as they are poisonous to kids and adults. Since then, the manufacturers have to demonstrate to FDA that their products are reasonable before they market them to the public.
